Terms of Service

1. Acceptance

By creating an account or using the Diabec application, website, or supplement shop (collectively, the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use Diabec. Users aged 13–17 must confirm a parent or guardian is aware they use the Service. You must provide accurate registration information and keep your credentials secure.

3. Not medical advice

Diabec is a wellness-tracking companion and dietary supplement retailer. The Service is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment. Nothing in the Service is intended to replace the judgement of a licensed healthcare professional.

4. Emergencies

If you are experiencing a medical emergency, CALL YOUR LOCAL EMERGENCY NUMBER FIRST: 911 (US), 112 (EU), 999 (UK). The in-app SOS alerts your chosen Care Circle contacts only. It does NOT contact emergency services and is not a substitute for them.

5. Accounts

You are responsible for activity on your account. Notify us at jeff@dia-bec.com of any unauthorised use. We may suspend or terminate accounts that violate these Terms or applicable law.

6. Supplement purchases

Diabec supplements are dietary supplements and have not been evaluated by the FDA. They are not intended to diagnose, treat, cure, or prevent any disease. Subscription orders renew automatically at the interval you select. You may cancel any time from your account or by emailing jeff@dia-bec.com before your next charge. Our refund policy is published on the website and applies to first-time orders.

7. AI features

The Service uses AI to estimate carbohydrate content from meal photos, predict short-term glucose trends, correlate sleep and glucose, and summarise your history.

All AI outputs are INFORMATIONAL ESTIMATES ONLY, may carry material error (±20% or more), and must be confirmed with a licensed meter or clinician before you act on them. Never make insulin dosing, medication, or treatment decisions based solely on a Diabec estimate.

8. User content

You retain ownership of the data you enter, including glucose readings, meals, notes, community posts, and private mental-health check-ins (distress score, mood tags, and notes).

Private entries are never posted to the community; only you (and anyone you explicitly invite through Care Circle with matching permissions) can read them. You grant Diabec a limited licence to process this data to operate the Service, including optional AI features that read your recent entries to generate private reflections.

Community posts are public to other Diabec users. Community content must not contain medical advice, promotional material, harassment, or illegal content. You are responsible for what you post.

Diabec is a wellness-tracking app, not a crisis or mental-health service. If you are in danger or in a mental-health crisis, call your local emergency number (911 US, 112 EU, 999 UK) or a crisis line such as 988 (US), Samaritans 116 123 (UK / IE), or 13 11 14 (Australia).

9. Intellectual property

The Service, including the app, branding, and content we create, is owned by Diabec and protected by copyright, trademark, and other laws. You may not copy, modify, reverse-engineer, or resell the Service without our written permission.

10. Termination

You may delete your account at any time from Profile → Delete My Account. We may suspend or terminate your access if you violate these Terms, misuse the Service, or as required by law. On termination, sections 3, 4, 7, 11, and 12 survive.

11. Disclaimers & liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. To the fullest extent permitted by law, Diabec and its affiliates are not liable for indirect, incidental, special, or consequential damages, or for loss of profit, data, or goodwill. Our total aggregate liability for any claim arising from the Service will not exceed the greater of USD 100 or the amount you paid Diabec in the 12 months before the claim. These limits do not exclude liability that cannot be excluded by law (e.g., gross negligence, wilful misconduct).

12. Governing law & disputes

These Terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales, except where mandatory consumer-protection law of your country of residence provides otherwise. Before filing a claim, contact us at jeff@dia-bec.com. We try to resolve disputes informally within 30 days.

13. Changes

We may update these Terms. Material changes will be notified by email at least 30 days before they take effect. Continued use after the effective date means you accept the updated Terms.
